All offers and services are subject to the following conditions unless otherwise agreed in writing. Terms and conditions of delivery and performance of customers require our written confirmation in order to be bindingly accepted.
By registering for one of our events or by commissioning a service, the participant accepts our General Terms and Conditions as binding. All orders require confirmation by e-mail or written form.
Open seminars are events that are advertised openly. Content and procedure are described in the respective seminar description. Changes that do not change the overall character of the event do not entitle the participant to withdraw from the contract or to reduce the invoice amount.
Registrations for open events will be processed in the order in which they are received. Registration can be made in writing, by e-mail, telephone or in person. It becomes binding with our invoicing. The invoice is regarded as order confirmation and registration certificate. A seminar or training place is only finally reserved upon receipt of the payment.
Destiny GmbH offers in-house events such as in-house seminars, incentives, events, lectures and management consultations in writing or by e-mail. With the order confirmation by Destiny GmbH, they are binding for both parties. A seminar is not finally reserved until the first payment has been received.
Our invoices are payable at the latest 10 days after invoicing without deductions. If the participation fee has not been paid at the beginning of the seminar, we reserve the right to exclude the participant from the course. There is no entitlement to reimbursement of travel and/or accommodation fees or loss of working hours. The legally binding value added tax is shown separately for all prices. The seminar fee does not include the daily rates in the seminar hotel, this amount will be invoiced separately by the hotel. The fee is due no later than four weeks before the start of the seminar. If the registration takes place within four weeks before the seminar, the entire fee is due upon invoicing.
50% of the agreed fee will be invoiced when the order is placed and 50% directly before the event. Invoices are due immediately without deduction.
Cancellations must always be made in writing. You can cancel up to six weeks before the start of the seminar free of charge. Cancellations up to 4 weeks before the seminar start will be charged 25% of the seminar fee. For cancellations up to 14 days before the start of the seminar, Destiny GmbH will refund 50% of the fee. In case of cancellations after this date or in case of non-attendance, the total amount is payable. Cancellation costs may also be incurred by the hotel, which must be borne by the participant or the company. A substitute participant, in the case of women's seminars a mandatory substitute participant, can be reported at any time. In the case of a substitute participant, the cancellation fee does not apply. If a participant does not make use of the services or parts thereof, there is no claim for reimbursement for the unused part. Destiny GmbH also reserves the right to cancel or postpone seminars for important reasons, e.g. if a trainer is ill.
The fees or participation fees invoiced relate exclusively to the event, the seminar documents and the catering during the seminar breaks. Hotel, travel and transfer costs are not included, unless otherwise expressly stated in the seminar invitation.
If an open seminar has to be cancelled by the organizer, the participant will be given three alternative dates to choose from. Alternatively, Destiny GmbH will reimburse the fee already paid in full. Further claims due to a date cancelled by the organizer are excluded. Destiny GmbH reserves the right to cancel a seminar or training if the number of participants is too low. Of course, this does not apply to individual coachings.
If an in-house seminar is cancelled by the client and a postponed seminar takes place within 6 months of the originally agreed date, half of the amount already paid will be credited against the agreed total amount. In the event of cancellation or postponement by the client, any third-party costs already incurred by Destiny GmbH will be charged separately and invoiced to the client.
As a service provider, Destiny GmbH shall be liable for the maximum amount of the fees already paid. Any kind of compensation beyond this as well as the claim for possible third party damages is excluded. This also applies in the event of a short-term cancellation of an agreed event date, if this is due to illness of a trainer or prevention of the event by force majeure.
In case of cancellation of a seminar due to force majeure (e.g. illness of a trainer or other unforeseeable events) or in case of cancellation due to organisational reasons, there is no claim to the holding of the seminar and no claim to reimbursement of travel and/or accommodation costs or loss of working hours.
Participation in all events is at your own risk. Destiny GmbH shall be liable within the scope of the statutory liability up to the amount of the fees or participation fees already paid and only if it has acted wilfully, grossly negligently or has not violated any essential contractual obligations. The liability for force majeure, any kind of compensation as well as the claim for possible third party damages is excluded. In the seminar offer of the organizer there is no insurance cover.
The participant is also responsible for wearing suitable clothing (sturdy shoes, waterproof clothing if necessary, etc.). In addition, the organizer assumes no liability for dirty clothing and objects brought by the participant (e.g. mobile phone, tablets, etc.).
It is the participant's own responsibility to wear a riding cap during the exercises on horseback. These will be made available to the participants by the organizer. Due to the aspired naturalness, the horses are mostly led without bit (with and without rider) and ridden in the seminars. The participant is aware of this and takes note of it. Riding a horse is only permitted at the participant's own risk (with or without helmet).
In the course of the event, the provider must strictly follow the instructions. In the event of any violation, any liability is excluded and Destiny GmbH reserves the right to exclude the participant.
No liability is assumed for information, prices, dates and for the content of linked pages. The organizer accepts no liability for the personal belongings of the participants, including the documents provided, even in the event of theft. The organiser shall not be liable for any damage suffered by the participants outside the seminar rooms or training locations on the way there or back. The organiser shall only be liable for damage caused to participants within the seminar rooms or training locations if she or a natural person acting in accordance with her instructions can be accused of intent or gross negligence.
The costs for board and lodging are borne by each participant or the sending company itself. If required, we are happy to make suggestions. We would like to point out that in this case we only act as intermediaries. In this case, the hotel will invoice the flat rates directly. Any cancellation fees must be paid by the participant or the sending company.
At the end of the seminar each participant receives a certificate of course attendance.
Each participant receives seminar documents. These seminar documents are intended exclusively for the personal use of the participant. Destiny GmbH retains the copyright for these documents as well as for documents or work aids that have been developed during the seminar. Reproduction is only permitted with our express written permission. This also applies to duplications in extracts. We reserve the right to claim damages in the event of infringements. Other forms of use (sale and/or exchange of documents) also violate copyright.
All text and image materials produced by Destiny GmbH, such as seminar documents, videos, photos, brochures, manuals, elaborations, publications are and remain - regardless of the type of publication - the intellectual property of Destiny GmbH and are protected by copyright.
It is expressly prohibited to use the texts, videos or images of Destiny GmbH for publications, training courses, management consultations, lectures or comparable opportunities. Duplication or transmission to other natural or legal persons is considered a violation of copyrights and is punishable by law.
Video recordings are made during the training sessions and photographs are taken. The participants agree that this video and photo material may be used for advertising purposes by the organizer. Should this not be desired, this must be communicated in writing at the beginning of the seminar or training. Participants agree that sound, picture and/or video recordings may be published in the context of the seminar or training.
The participants in our events are obliged to maintain confidentiality, i.e. no information may be passed on to third parties that could lead to the conclusion that a particular person is involved.
Destiny GmbH reserves the right to change speakers, course days, dates, starting times and venues. The participants will be informed in good time. Reductions in participation costs are not justified.
Accommodation expenses in connection with the organisation and execution of external workshops and advanced training events will be charged separately.
The costs/rental fees/rental for the premises required and their equipment with functional or technical aids or other extras shall be borne by the client.
In the event of any dispute arising out of or in connection with the interpretation or application of these Terms and Conditions, it shall be agreed that a mediation attempt of at least two sessions shall be made prior to recourse to any court.
Invoices and information are always sent by email. In exceptional cases, invoices and information may be sent by post.
The law of the Republic of Austria shall apply to all business relations and legal relations between Destiny GmbH and the seminar participant or the contracting company. Should a provision of these General Terms and Conditions or a provision within the framework of agreements going beyond these be or become ineffective, the effectiveness of the remaining provisions or agreements shall not be affected thereby.
Amendments to the contract and these General Terms and Conditions must be made in writing; likewise a departure from this formal requirement. Verbal collateral agreements do not exist.
Place of jurisdiction is Innsbruck.
